£5,500 for store worker in picker truck collision

Les Anderson was driving his electric picker in a warehouse, collecting products from the shelves and loading them into the truck’s pallet. He stopped at one of the aisles to exit the vehicle. As he was getting out, his picker truck was struck from behind by a colleague in another picker. The trucks are designed to stop automatically when the driver takes his foot off the accelerator pedal but due to a faulty mechanism, his colleague’s truck couldn’t stop in time. Mr Anderson suffered an injury to his lower back which kept him off work for several weeks and he took nearly a year to fully recover. He contacted Rapid Solicitors, personal injury law experts, to pursue a claim for compensation.
A Solicitor at Rapid, said: “Our client was off work for some time and returned on light duties, so as well as suffering a painful injury he also lost a significant amount of earnings, which we were able to recover. We gathered our witness statements and evidence of the truck’s mechanical failure and persuaded the Defendant’s to admit liability. We alleged negligence on the employer’s side for allowing an employee to use a defective vehicle. Its braking mechanism didn’t operate when it should have done, causing our client avoidable injury. Employers must take measures to detect risks in the workplace with the work equipment involved.” Mr Anderson said: “I thought the entire process was handled really well by Rapid.”
